If you are under 18-years-old, you warrant that you have obtained consent from your parent or guardian and they agree to be bound by these Terms on your behalf.

Our Service allows you to submit photos, links, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By submitting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any, and all of your rights to any Content you submit, share or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your content available to other users of the Service, who may also use your Content subject to these Terms.
You represent and warrant that: (i) the Content is yours (you own it), or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the submission of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. Further, you warrant that: (i) the Content will not cause you or us to breach any law, regulation, rule, code or other legal obligation; (ii) the Content will not or could not be reasonably considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy; (iii) the Content will not be unsolicited, undisclosed or unauthorised advertising; (iv) the Content does not contain software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware or telecommunications equipment; and (v): the Content does not bring the Service or us into disrepute.

We are under no obligation to regularly monitor the accuracy or reliability of your Content incorporated into the Service. We reserve the right to modify or remove any Content at any time.
You acknowledge and agree that all Content you provide on the Service will be publicly available information and you bear the risks involved with such public disclosures.
Our Service may contain links to third-party websites or services that are not owned or controlled by Pulchritude.
Pulchritude has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Pulchritude shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
We only provide links to external websites as a convenience, and the inclusion of such a link to external websites do not imply our endorsement of those websites. You acknowledge and agree that when you access other websites on the Internet, you do so at your own risk.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend your portfolio, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection in addition to that.
If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by sending a communication to any address (email or otherwise) that we have for you in our records.
As a condition of your access to and use of the Service, you agree to indemnify us and our successors and assigns for all damages, costs, expenses and other liabilities, including but not limited to legal fees and expenses, relating to any claim arising out of or related to your access to and use of the Service or your breach of these Terms and any applicable law or the rights of another person or party.
This indemnification section survives the expiration of your registration and applies to claims arising both before and after the registration ends.
Posts can only be deleted three months from it's publication on Pulchritude. No refund will be made once it is posted and even deleted. Pulchritude spreads will not be deleted once it is published online.
You agree that we shall not be liable for any damages suffered as a result of using the Service, copying, distributing, or downloading Content from the Service.
In no event shall we be liable for any indirect, punitive, special, incidental or consequential damage (including loss of business, revenue, profits, use, privacy, data, goodwill or other economic advantage) however it arises, whether for breach of contract or in tort, even if it has been previously advised of the possibility of such damage.
You have sole responsibility for adequate security protection, and backup of data and equipment used in connection with your usage of the Service and will not make a claim against for lost data, run time, inaccurate instruction, work delays or lost profits resulting from the use of the Service.
Without limiting the preceding, in no event will our aggregate liability to you exceed, in total, the amounts paid by you to us.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, or destruction or unauthorized access or, alteration of or use of record in connection with the use or operation of the Service, whether for breach of contract, tortious behaviour, negligence or any other cause of action.
We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of the content that are on the Service for any purpose. Any reliance you place on such information is therefore strictly at your own risk. By submitting to Pulchritude, you are providing us permission to crop, make basic edits, and select from your submitted content. We do not guarantee that all photos accepted will be used. As a submission based publication we provide contributors with a professional and curated platform to showcase their work, as such, it should be known that we do not pay for submissions. Any expense or cost incurred from your shoot is done so at your risk and expense. All submissions can be considered for our cover. However, it is not guaranteed. We reserve the right to make last minute changes.
By submitting this publication form to Pulchritude, you at this moment state that you are in fact 18 years of age or older. You and your constituents agree to hold harmless Pulchritude, its owners, employees and acting agents/constituents. Also, upon submission, you and all of your constituents agree to have any and all rights revoked in a court of law. As a professional digital entity, we take what we do here very seriously, and ask that all contributing submitters do the same. All submissions will be prioritized according to the quality of the photos you sent and the answers based on the answers you have provided. The time frame we gave you on our communications and correspondents are approximate and may changed without prior notice. You do not have the right to complain and demand. Pulchritude reserves it right to delete entries for whatever reason.
Pulchritude requires high-resolution photos for the portfolio and publications. If you have failed to send us the required photos (at least 2MB file size, 300dpi), we will not be able to feature you until we receive the photos required. Pulchritude has the right to delay your feature even you have paid for the feature. We do not refund once you are published, Pulchritude will have to wait until the photos required are received.
Refund will not be issued once you are published on our Social Media and the campaign has already been created. Pulchritude has the right to choose from the photos you submitted to post on our Instagram accounts. We have the right to refuse your request/demand regarding the Instagram posts, if you have any.
In the interest of everyone involved with Pulchritude, we ask that models and photographers maintain a high standard of professionalism and understand that once images have been published in Pulchritude, they are now legally the property of the publisher and shall remain published as such. If a special circumstance arises Pulchritude, is more than willing to help and address any issues that models and photographers may have after publication.
We are thrilled to be able to offer our platform to fashion talents, creatives and brands, but ask that should you wish to be featured in our publication that you carefully consider all of the above.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide notice before any new terms taking effect.
It is your sole responsibility to periodically check these Terms for any changes. If you do not agree with any of the changes to these Terms, it is your sole responsibility to stop using the Service. Your continued use of the Service will be deemed as your acceptance thereof.

As mentioned on this page you own the copyright, you have the right to distribute, publish and authorise Pulchritude for your publication to our platforms (Magazine, Feature, Portfolio and Social Media). We will use the photo credits you provided us. Pulchritude would never own it.
Payments are not refundable once we have published you to our portfolio. We have received a few "fraud" or "product not received" cases with payments that some clients make. Their banks have successfully credited their money bank, businesses like ours suffer from the chargebacks. Not only clients who reported their transaction fraud even they knowingly made the purchase hurt our record (through Stripe and Paypal), the business will also have to pay the chargeback fee of $15.00.
Having said that, when the dispute is being made, and the bank decided in "your" (the client) favour, we will then go to the extra investigation through our third party partners and check the following information:
When our records show that you are the owner of the credit card information yet you reported the transaction as Fraud; you, therefore, give Pulchritude the ownership of the materials you submitted. We will take necessary actions against "you" (the consumer, the person who proceeded with the transaction, the person who reported the transaction as fraud) to avoid such deals to happen again to other businesses.
It is important to make sure that you check your credit card information and contact us at This email address is being protected from spambots. You need JavaScript enabled to view it. if you have questions about a transaction, before reporting it as Fraud.
In general, you will be allowed to request removal of your portfolio after three months from the original publication date and the magazine publication is final. Instagram, Facebook and Pinterest announcements are final and cannot be removed from our social media.
